    Statement of claim
    Husband lost job 4 yrs. Ago can no longer pay mortgage for 4 months now. They want $11,000 by DEC 31st.2010 we don't have this $ how fast can they evict us from this house it's winter now my 92 .5 yr old mom lives with me ,we are 63 and 58 and have 2 teen children 19 + 17 and 3 dogs.

    First they have to foreclose. Have they started foreclosure proceedings yet?

    No foreclosure here in canada we are told if it is a statement of claim they can evict you faster than if it was power of sale or foreclosure..? I am so lost

    See, that's why its important in any matter of law to give your general locale.

    Yes Canadian mortgages work differently (Foreclosure Rules in Ontario). So once the property is sold, you become a month to month tenant and can be evicted with 30 days notice.
