Ebay wants me to pay them money they refunded
We sold an item on Ebay. The buyer appearently decided he didn't want it and filed a complaint with Ebay. We were out of state at the time taking care of my mother. When we got back Ebay decided in favor of the buyer (they give you 7 days to respond) and sent him a refund. The complaint was, in my opinion, fraudulent. The buyer said the camera had a scratch on the bottom and box smelled musty. Neither statement was true and I offered to send Ebay pictures or any other proof they needed. Their response was "in conclusion, we are not able to approve your appeal request because we reviewed several factors before taking any action. In your specific case, we reviewed the listing, photos of the item, and communication between yourself and the buyer and we reached the decision that the item was not as described. Unfortunately we don't have the benefit of seeing the actual item. Therefore it was difficult for us to determine exactly what condition it was sent or received in. So, we decided to get both parties involved as closely back to square one as possible. To do this we had your customer send the item back to you for a full refund. Please understand there may be instances where buyer and seller may not agree on whether an item is “as described”. If a buyer has a concern with the item they received, try and put yourself in their shoes. I know it can be hard, especially if you feel that you are correct but ultimately it will leave you with a better transaction." It seems to me that they are saying they made their decision on what they did not know. I am on Social Security Disability and Service connected disability. I also receive a very small retirement check. Can they take money out of my checking account for this amount? Can they sue me and collect this money? I never said that I would take the item back and the listing did not offer a refund. Thanks very much.

Yes, you agreed to their terms and conditions when you used their service.

If you lose a dispute as a seller, they may take the funds from the same account they paid them into.

This is not a court garnishment, but merely a repayment you agreed to by using the service
