Responding to a summons for money judgement in Wisconsin Home Equity Loan
I was divorced in 2007 and as part of the divorce my ex-husband was to pay the mortgage and home equity loan associate with our marital home until the time the marital home was sold. It just sold in August of 2010 and he defaulted on both loans not paying either since Nov 2009. We entered into a short sale situation and as a result only $4,500 of the $50,000 Home Equity loan was satisfied. As a result, the bank is now suing both my ex-husband and I for the remaining amount. I have until Monday, November 29th to respond to the summons. I have no money and can not afford an attorney and I need to know how to respond to this summons to preserve my rights. Can anyone help with specific a way or example of how to respond? We both owe the money but are in a extremely difficult financial situation. He has not paid child support since Nov 2009 and I am close to now losing my own home as a result of his financial decisions. I need any kind of help someone is willing to give!

    Hello K:

What's answering the complaint going to do? Give you more time? For what? As you admitted, you owe the money. Yes, when you negotiated a short sale with your mortgage holder, you SHOULD have done so with the other lender to... But, that's water under the bridge, and I'm sure you've beaten yourself up enough over it...

You are a prime candidate for bankruptcy. I HATE giving you that advice, but I cannot think of ANY other solution. It'll stop the court fight dead in its tracks, and you can save your present home.

does not find this helpful: Sarcastic and obvious.
    Hello again, K:

Ok, then. I hope you lose EVERYTHING.
