    Judgements and bankruptcy
    Hi
    My friend has a question she got a judgement filed bankreuprcty and she wants to know will this mean she will not have to pay the judgement? I told her she should have asked her lawyer but she said he was talking so much she can not remember He did tell her that with the means test she will file chapter 7 she has no house only a 12 tear old car but is in credit card debt for about 20,000 I told her I would ask this for her

    It will depend on what the debt is for, some items like fines and student loans can not normally be done away with in bankruptcy, but yes that is what bankruptcy is where you don't pay the debts, but the judgement is still in place until the actual bankruptcy is filed.

    Thanks for the info, Her judgement was for a credit card debt she got in over her head now that she has filed {or paying toward filing} I know she will feeel better knowing this judegment will not have to be paid it was for 11,000! I wish she had taken steps to prevent this but I think she thought by ignoring it it would go away! Any I told her SHE SHOULD NOT EVEN THINK ABOUT GETTING A CREDIT CARD AGAIN!

    Your friend would be very wise not to quickly jump into any debt, particularly credit card debt. After filing she'll get a ton of offers for credit cards and new car loans. The lenders are ready to suck us right back into the credit trap.

    After bankruptcy there's a real need to step back, get control of finances, and to really look at the 'why' of the bankruptcy. Rarely are the reasons purely financial. She'll eventually want to re-establish credit, once she learns to manage her current finances. About 16% of bankruptcy filers will file again in 6 to 10 years (that's 200,000 people yearly) and there's plenty of help from the financial institutions to put you right back into bankruptcy. Don't fall for it.

    Once finances are in control it's possible to have fairly decent credit two years down the road from bankruptcy, and it can be done legitimately, without 'credit repair' scams. For now look at the real reasons for the bankruptcy and build from there.

    Iw ant to know if I have a judgement on me from a car accident from yrs ago and it was for 17000.00 and I still owe totady 8 or 9 I pay it by the month to a lawyer 100.00 a month and I want to file bankruptcy on everything can I file on that too they tell me if I don't pay it I can lose my drivers lic or can I file that too? Thanks
