My friend owes money to Chase and it went to collection agency National Action Financial Services. Chase said they got paid in full we would like to get a copy to that effect, however they said the debt is out of Chase's hands. He was told to contact National Action Financial Services. My friend Bob would like to know who to contact first and find out the total amout paid so he knows exactly what he owes.

You contact the collection agency for documentation of the settlement.

We called National Action Financial Services and Anthony Ryan said "we do not have information about how much my friend Bob paid to Chase on the 2002 Dodge Caravan, the vehicle was taken to Southern California Auto Auction in Fontana, CA and they received a few thousand dollars from the vehicle being auctioned." When we called Chase a person there said " They already got paid in full".

A few weeks ago National Action Financial Services recorded my friend Bob and they agreed he will pay $ 4,000.00. About a week ago they sent another letter stating the balance was $12,955.41, not the $ 4,000 that was recorded and agreed over the phone; National Action Financial Services already agreed that all Bob must pay is $ 4,000 total. Nothing was given in the mail to Bob stating that the balance is $4,000 it was all recorded over the phone, nothing sent in writing about $4,000 only $12,955.41. What are Bob's rights about this?

As a result of this collection notice owing a balance of $12,955.41, an employee at Chase Automotive gave verbal testimony they already got paid in full; National Action Financial Services claims Bob owes $12,955.41 after the 2002 Dodge Caravan was sold at an auction for several thousand and they they recorded a verbal agreement of Bob owing now only $4,000 but have sent nothing in writing about $4,000 interest free and only $12,955.41 as the amount. Bob wants to file bankruptcy. Is there any way to discharge this debt without filing bankruptcy?
