I moved out on 10/15/10 just 2 blocks away from the old place. Landlord told me that she will take only a week to return my security deposit, I asked landlord to call me for the when she has my security deposit refund and I'll come to pick it up. I really didn't want her to know where I live, she's a shady person and don't want any future disturban from her. So on Nov.3rd I called her and left message in regards to my security deposit refund and said that is almost past the 21 days refund period. She didn't call back. So, I called again on Nov. 4th and spoke to her and ask her to give it to one of the neighbor and she agreed. The neighbor called me on Nov. 11th that I got the from the landlord so I came by to pick up. The landlord wrote up an itemized with substantial charge out of my security deposit such as: carpet cleaning for (1 room $ 100), paint, nail + repair advertise fee and others unbelievable charges. And even on the security refund check she back date the check to Nov. 6th but she didn't really refund it until Nov.11th. So I called her right away to reason but she refuse and hand up. What can I do in this case? She lies and back dated the check and charges unbelievale amount out of my security deposit. Oh, when I moved out she did a walk through with her and she sign a letter stating no visible damaged to the house so can she charge me all of this. The house was cleaner then when I moved in there was no new paint and she still has her stuff there when I moved in, I have to clean the place and help her take her stuff out to the backyard on the day I move in, and the carpet was clean so I bought a carpet shampoo machine to clean it. And now she's charging me for the paint and carpet that is not right. Can you please help me with this, I would really appreciate all the help I could get. Thank you.

If she really is shady you will not talk her into a refund. Just consider sueing her in small claims and check if your state allow treble damages. Advertising and normal wear and tear are not to be deducted from security, only actual damages.
