    Does he have rights?
    I have sole custody of my daughter and her "father" has no acess & I have a restraining order on him.. but he is ordered to pay child support but has not and hasn't been involved or tried to be.
    My daughter knows my spouse as her father and I just want to know if her "father" has rights to her, because my spouse wants to adopt her..

    As long as he is still alive and until a court takes them away he does have parental rights.

    And the court rarely does. But it won't hurt to ask. If adoption is a viable option he might be OK with it because like an ex-spouse that remarries... support requirements would end with the child's adoption. And he clearly doesn't want to pay... or he would have. (footnote* he will still owe what's in arrears... but not future payments if that happens)
