Crossing US border from Canada with an Absolute Discharge
I have recently received an absolute discharge for simple possession of marijuana in Canada. Many websites state that an absolute discharge will not be considered as a conviction by US border law. Am I safe to cross the border?

In addition, I am not sure if anyone would know this, but if I were to wait a year (the required time for CPIC to clear my record) would I still be obligated to tell the US immigrations agent that I have been arrested in the past?

If asked, you must disclose all arrests, charges and convictions.

Absolute discharge, expungement or even a pardon does not change the fact of the arrest, charge and conviction. Have evidence of the final disposition with you. Good luck.

Any idea if having an absolute discharge would prevent me from being able to cross the border?

Is it true that the CPIC can clear someone's records of theft under 5000 after one year? How does one go about doing this? I have also been arrested for theft under 5000, and received diversion.

I have a misdemeanour and the alleged events happened in May 1995, but the Canadian authorities are equating this to a Canadian law that wasn't passed until 1997... is this legal? I ask because they are counting this misdemeanour as a "serious" criminal offense. Just doesn't seem fair to do that.
