    Can someone get fired on their day off for being sick?
    My Daughter was fired for being sick on her day off!

    My daughter had a Sunday off and she was not feeling good.
    She had a stomach bug which soon we all came down with later that week.
    Her boss called her to work because she didn't want to work that day.
    My daughter explained to couldn't go to work because she has been sick all night and still sick when her boss called her.
    Her boss insisted that my daughter work and that she wasn't following orders.
    Again my daughter told her that she did not feel good and would not be able to work that day.
    Her boss told her that she was getting angry and hung up.
    After a while my daughter got a text message telling her that she was not happy with her actions and she was letting her down. By TEXT MESSAGE! Can you believe that?

    My daughter replied telling her that if she was not happy with her actions she all she had to do was just give her a 2 week notice.
    The next text message reply form her boss read: "Forget the 2 weeks!" "You can pick up your check tomorrow!"

    I was at home at the time and I know my daughter did not make this up.. I told her to save the text messages about her bosses unprofessional actions. Ny daughter does not want to look for another job now because of fear of getting treated the same way by another employer. She will not do anything about this because her boss is a very good friend of her's from school. What can I recommend for my daughter to do? She does need to work to help pay for her tuition! Her employer has scared her mentally and abused her verbally.

    It sounds like your daughter turned in her 2 week notice and the employer declined it. For one thing tensions were running high. She shouldn't have said anything in the heat of the moment. And most likely it is a legal firing.

    Most likely nothing would have happened but daughter was quiting because of that action, and the boss angry, esp after the 2 week notice,

    Had she just not texted back, she would have still had her job.

    But yes of course in most states ( in the US) they can do this, unless she has a contract or there are set company rules in place.

    If this is a larger company, she could appeal to be allowed to work her 2 week notice ( or be paid for the notice)

    I see no case, just from personal and known experiences.
    'Ny daughter does not want to look for another job now because of fear of getting treated the same way by another employer' is just foolish. If you are gearing for some sort of reason to collect damages, benefits, or unemployment, I think you will be very disappointed.
    'Her employer has scared her mentally and abused her verbally.' I hear nothing scary or abusive.
    Being fired is simply that and it happens all the time. Suggesting some sort of horrible trauma is not going to work.
    She handled the texting wrong. And we don't know what her work arrangements for being called on days off were.
