    Divorce Proceedings
    I have been going through a divorce for about 2 years. I am not the petitioner however both parties agree on the divorce. There is one minor child involved. Since the case was filed my spouse has not been efficient in turning in the necessary paperwork. I am being told that there is nothing I can do to speed this along because he is the petitioner so pretty much there is no consequence for this action. What can I do? If I get an attorney can they pick the case up from where it is? And if so can I ask that he be responsible for my attorney fees since he is the reason I am having to hire one in the first place?

    Why not talk to an attorney about this? Seems like 2 years is a lengthy period for a simple uncontested divorce.

    Maybe once you explain the situation to your own attorney, he/she will have an out for the divorce that's supposedly occurring now. If you were to have a hearing, the judge could order him to submit paperwork within a specified period. If the judge orders it he would be in contempt if he failed to abide by the order.

    Yes your attorney can ask for attorney's fees for you. That's standard boiler plate in most divorce proceedings. You need to retain a good attorney and ask them to incorporate the attorney's fees.
