    Guardianship of grandchild
    My daughter might be going to jail. She wants to sign over rights to me and her father. What kinds of steps need to happen? Does this mean no one else can get them from me?

    First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread. I also merged in your other thread.

    Second, ANY question on law needs to include your general locale as laws vary by area.

    Your daughter can't just sign over rights. You have to go to court and apply for guardianship or for adoption. The father will need to be contacted and approve of any court action. Guardianship is more temporary, adoptions more permanent.

    Agreed, where is the father in all of this, since he will have rights also.

    But you will have to go to court for guardianship. She can not merely "sign over" anything to you without going though court

    Unfortunately I can answer this answer from experience. When I went to jail in Florida in 2007 I immediately had a paper notorized stating that the person who had my son could provide medical treatment, etc until I was able to take care of him as failure to do so can causae you to catch an abandonment chage, the fact that you are incarcerated does not matter. However we all know that a norized paper is only as good as the paper it is written on so very shortly after that the person filed for temporary custody of my son. It was all legal. By the time they went in front of the judge for temporary custody I was in prison and was still able to attend the hearing by phone. Just remember. Good Luck.
