BF in GA jail due to contempt order in div decree, advice to get him out?
He was arrested due to missing the court date, but had no real warning of the arrest. But its been over four months, he did his time for that and had his case seen and judgement is pay 18k plus fees, or stay in jail. We have a review from a petition coming up, I am thinking of getting power of attorney and selling his stuff and adding to proposal to say he has no assets, or should he just forfeit them to court, either way just trying to get him out of jail, he can't pay while in there and has nobody to pay that or any amount. In the decree it states he agrees to "take care of the loan" It's a studen loan he missed payments on, also he was not around during the drafting of this decree.

But its been over three months, he has no way to pay. We petitioned for review coming up, told if he has no assets they can't legally hold him? I am thinking of getting power of attorney and selling his stuff and adding to proposal to say he has no assets, or can he just forfeit them to court and still be released? He can't pay while in there and has nobody to pay that or any amount. In the decree it states he agrees to "take care of the loan" It's a studen loan he missed payments on, also he was not around during the drafting of this decree. We feel he's being held illegally? Please help

Sorry something not right with the story,

    1. you can not be held or put in jail for a debt, so a student loan will not have you in jail, ( no way, not even possible)

If he missed a court date on a ciminal charge, then a warrant is issued for his arrest, and of course there is no notice you are just arrested.

So what was the original crime that he missed court for, and what is the outcome of that.

So sorry but he is not telling you something correctly if he has told you he is in jail because of a student loan
