When there's no will the inheritance goes to next of kin in a line that is determined by where he lived (in the US, by state, so Google inheritance laws where you are). You would have to have DNA tests probably and file a claim, unless next of kin agree that you are his son. If he was cremated, or buried and you can't afford all this, you may have a tough time. If he was your dad by virtue of providing for you, that may help your claim. But a lot will depend on who else survived him.

The first question is whether he was ever established as your legal parent. Doesn't matter if he's on the birth certificate or not, what matters is your legal relationship.
Once that is established, then you can look into rights of inheritance.

Not so sure on this Scott. I'll be watching how this developes but I believe a bio dad who never recogized his child or parented , that child still has standing in inheritance without a will. Bet AKlawyer will jump in soon. Or Lisa.

I don't disagree, but, without his being on the birth certificate, the bio relationship has to have been proven legally.

That is very true, especially if the dad's DNA is not available.

Ok so my father passed away last year. A few months before he died he was in a car accident. I do not know the full details of the accident but apparently he was drunk and rear ended someone. Now there was MINIMAL damage to both cars. You can barely tell that his car was in an accident. Now this...
