My Ja'kayla and I'm 16 years old. I been living with my mom most of my life since I was a baby. I hate my life with her because she haven't been a good mom and didn't do a good job raising me. My mom and dad has a very violent history together they never got alone for nothing a two months ago my dad was going to help my mom to get into a apartment because my mom couldn't get in her name. So my dad explain to my mom that she could do certain things at the new my mom didn't like some stuff he was saying. She told to stay at home while they went to take of business so I did next thing I know I got a call from my mom saying my dad physically abused her in the car and the police took him to jail I was very sad about it. Well he got bond out of jail I haven't heard anything from him until a month or so he was mad at me because I was telling my grandma how bad a person he was. One day I was at school and the office called me down and told me I was going home I didn't know what was going on. I seen my dad standing there so he took me to subway to talk to me about the situation. He told me a whole different story then what my mom told me basically he said she was lying about it and said the same about him. A couple days ago my dad pulled out of school again because I was planning on not going back home because my mom was really treating me wrong. So I took some clothes with that day, I went with him over a relative house it was getting later and later and I didn't contact her because she starts too much drama. She called my grandma to ask her if she could call my dad but my grandma did and didn't get an answer so she called where I was at she wanted to speak me when I got on the phone she asked where I was at I told so if told my mom where I was at. My mom start calling over there screaming and yelling over the phone at me. She said that she was going to call the police over there but she decided to come get me herself . She called again to tell me she out there I didn't want to go I was taking awhile to leave so she got very upset came to the door knocking telling me to come on. I still didn't so she snatched me very hard by the shoulder and dragged me to the car. All the drama that night caused me to miss a day at school. The next day she cool downed about so she warned me not to do what I did last time I said okay. I went to school not knowing that my dad was taking me away again. In my head I was saying "here we go again" so I didn't any clothes with me nothing but the clothes on my back and book bag. I had to spent the whole day with my dad. Finally I went back with my dad to his home and we talked some more about the situation he told me that I shouldn't have to live that way anymore and I could choose whoever I want to live with. At the moment I'm very stressed because I had to miss another day of school which is causing me to miss out on a lot of work. I'm here now at his house while he's out taking care of business. I couldn't go to school because I didn't have any clothes to wear to school I have on the same clothes from yesterday. I couldn't tell every detail but this is mostly what I'm going through at the moment. I need someone advice really bad if someone could help me out I would really appreciate it very much.

If mom has legal custody, then dad has to go to court to ask for a modification. If he just takes you, it will make him harder to get the modification.

What is the legal status of custody?
