Adopting my wife's 4 year old son in a same sex marriage?
Hello I'm yady I'm marring my soon to be wife Lisa she has a 4 year old son who dose not have is father last name,and I want to adopt and give him my last name ?do I need to speak to a lawyer?by the way were in the state of Massachusetts.. yours truly yady and lisa

Yes. You probably need a lawyer for this. While you are at it, consult a spelling teacher. It has been proven that people who can't spell don't make good parents.

The child's mother will need to get the bio fathers permission for the adoption, or fight in court to get his rights taken away.
Is the bio father at all involved in the child's life.
Is there child support
The fact he is not on the birth certficate does not take away his ability to have rights to the child.
So she will need to get an attorney,

So, now that I think about it, when and if OP gets an adoption approved, and she applies for a substitute birth certificate, what will said certificate say about the "father" of the child?
Questions of that nature aside, this case seems to indicate that such an adoption in Mass. Is do-able.
