    Roommate not on lease refuses to move or pay rent
    While I was out of town for business I agreed to rent my place out to a person I didn't know very well. When I returned, she had been living in my home for 1 month. I returned to find that she had moved her 20 year old stripper daughter in my house & was living in my room. Each month she has been late on rent. This is the 3rd month &.this month she refuses to pay & told me that if I wanted her to leave I would have to give her a 30 day notice & she will not be paying rent & will leave after the 30 days. So basically I have to pay her portion for October ($800) + $ (400) for November for her. I found out recently that she is her illegally from Canada as well. I called the police to try & get her out they said the only way was to get a Temporary Restraining Order on her & she would have to move. Went to court today & judge gave me a court date for October 29th. Is there any way to get her out sooner. As I cannot afford her rent & mine as I am launching a company right now. HELP!!

    Nope, if she is not paying, your state will have a pay or quit notice, often 3 or 5 days, and then if they don't move, you file in court for an eviction, but a oct 29 date is really a fairly good date, also remember that is only the court date, they may allow her time to move after court.

    ANY question on law needs to include your general locale as laws vary by area.

    Most areas allow for a 3-10 day pay or quit notice. The # of days depends on the area. If she doesn't pay by the deadline then you file for an eviction order. You can check with your local housing court as to the exact procedure for an eviction.

    She is your tenant since she's not on the lease you have with your landlord. You will need to prove you have a rental agreement with her.

    Next time, you should get and check references before you allow someone in your home.

    By the way, being a stripper does not make the daughter a bad person.
