Respond to motion for summary judgement from debt collectors
Basically, I am not guilty and have stated so in previous communications with a law collection company and provided evidence. I signed a contract in 2004 which I terminated in 2005 and got a credit back upon termination. 5 years later, in 2010, the company claims I owe then $1,700 + attorney fees. This has gone back and forth and I have requested proof of evidence for the debt which has never been provided. I have written documentation from 2005 with the company releasing me from the contract and giving me a credit. Yesterday, I received the MSJ with evidence of the 2004 contract. What is the best way to close out this dispute and put an end to these communications?

You file your response denying their claims and providing your evidence that the contract ended WITH THEIR PERMISSION.

Is that what you are asking?

Yes - is there a formal legal form that I have to use? Their MSJ contained all types of examples of other legal suits and state that my previous denials are overcome by an affidavit which is sufficient to sufficient to support a summary judgement. From my research, it appears that my response should be clear and in the past, I have done the responses myself after research
