I have a 16 month old son. His biological father has maybe seen him 8 times since he was born. He has been in and out of jail for Child support. The reason of this is because he refuses to pay it and keeps getting into trouble over it. In the beginning we set up visitation as when he wanted to see his son he was allowed to. I never stopped him from doing so. He just choose not to call nor see his son until he wanted to. I want my son to know who is father is but then again I also don't want him influenced by his fathers actions. Every time he seen his father growing up which was about once a month if not go four months without seeing him, he would scream his heart out. It tore me up inside to see my son go through this and not be able to help. My son is a fun, loving child and has never done that before even with strangers. My son hasn't seen nor talked to his father since new years eve. His father has not seen anything of what my son can do. I'm a single mother trying to the best I know I can for my son. I just found out that his father is currently in jail. I want to know if there was anyway possible for me to either get his rights taken away or at least have the comfront of if anything happened to me, my son wouldn't go to him. I don't want my son to be in that kind of life style and wonder who would take care of him while is father went back and forth to jail which he has done my son entire life. Its really sad to say that his father could walk through the door now and my son wouldn't even know who he was. Please help me and try and figuare something I can possible do.

Laws vary by where you live, and normally this is not enough to get rights revolked, you may go back and get the court ordered child visits limited a lot more.

And he is not visiting the child anyway, so he is not using any rights

Courts are very reluctant to terminate a parent's rights. There is a sticky note at the top of this forum that discusses the issues of terminating rights. Please read it.

Right now he is not exercising his rights so there is really nothing to terminate.

Maybe he isn't paying child support because he can't keep a job.

Maybe he can't keep a job because he keeps getting thrown in jail.

And if someone kept having me thrown in jail I would also tend to think that maybe my visits weren't welcome.

Has custody been decided yet by the courts? If not it should be.

Okey maybe I should have also made it clearier in my question that it is not my case of which he has not been paying child support and keep getting thrown in jail.. it is of another child of his. I have always tried to make him know that he was able to see his son anytime he wanted to but he choose not to call nor come visit him.
