Are there penalties for giving less than 60days notice?
My lease is up on October 14 and I do not want to renew because I can no longer afford it. I will be giving my notice on tomorrow which is September 8, will I have to pay any penalties for giving less than 60 days notice?

Without knowing the wording in your lease there is no way to know. You may also be in a State which does not require notice when a lease is involved as the lease is automatically terminated.

I am in NC and the lease does specify to give a 60 day notice, if the rental office did not enter a specific timeframe then it would be a 30 day notice. I am assuming it would be up to the rental office managers judgement.

And 60 days isn't the norm. 30 days maybe.

Please do not use the Comments feature for providing follow-up.

If your lease requires you to give 60 days notice, then you can be held responsible for the rental for 60 days from the date you gave notice. You will need to discuss it with the management company to see whether they enforce this.

You would assume wrong. Extending the lease or walking away should be covered in some fashion. A lease is a contract and all terms and conditions are in the paperwork, not at someone's discretion.

You could have serious issues, if the lease renews if no notice is given within 60 days, so the wording of the lease is very important.

Also notice is normally considered from pay due date to pay due date, so you may considered liable for Oct and Nov payments or at least till the Nov 8th.

So you are going to give the 60 day notice if you want to or not, because you are required to pay for that time
