    How to get child order to not leave state
    How do I get my wife from leaving the state with our children? I am going to talk to a lawyer Monday on the matter.We are not divorced yet in any way. Not even separated. She is leaving 9/03/10-9/06/10 with our 3 kids. She says she is going on vacation to see her sister but I don't believe her. I think she is no doubt going to look for another job down there and a place to relocate. I think she is scouting the place out and I don't want her to subject our kids to the possibility of that. Help in AR, Jeremiah

    You can go to the division of the Court in your State without an Attorney and file for a temporary, emergency Order which would forbid her to PERMANENTLY leave the State. You have - as I see it - no grounds to keep her from vacationing somewhere else, other than your own "gut" feeling.

    If you wait until Monday I very much doubt there is time for anyone to get any type of Order - in fact, tomorrow may also be too late.

    As long as you are married you have equal rights to the children. I wouldn't be concerned about her "scouting out" jobs and places to live because you most likely have time to get an Order keeping her from MOVING.

    At this point you would have to present proof that she doesn't intend to come back OR that the trip would be emotionally or physically harmful to your children and I don't think you can do that, particularly on short notice.
