Pictures of my stepson and legal issues
My husband has joint legal custody of his son but the mother has full primary custody. She's claiming to take me to court for child pornography and more because I have pictures of my stepson on my myspace page on the internet. WHat's the law pertaining to putting pictures up on the internet when I'm the one taking the pictures of him with our daughter and us when he's with us... she's saying because she has primary custody I have to get her permission to have anything up if it has to do with her son. He's 2. Please let me know if you know.

So long as the pictures DO NOT violate the TOS ( Terms Of Service ) for myspace then they are OK to post. That being said there is also a question of intellectual property ( since you originated ) the pictures. Keep in mind that once you post them they become the property of myspace and your children ( or step child ) could end up in an ad and you won't have any say over it. Maybe for the future lock out your myspace page and set it to private so only those with an invite can view it. In the long run it could save a lot of hassles.

All the pictures are fine, there's no pictures showing any private parts or anything. The mother is just jealous and angry and trying to do something to keep me out of her son's life. I had my page on private, however, I took it off briefly so that my family in SOuth AFrica could view the pictures and see what was going on in our life (they haven't gotten to meet my husband and the kids yet)... and she kind of stalks my page so ended up viewing them. SHe's 20 years old and hates the fact that I show equality when it comes to my daughter and my stepson, because she doesn't want her son to have another mother figure (which she can't help). She supposedly even had her husband place a no trespassing warrant against me so I woulnt be able to step on their property when we go to pick up my stepson. And she has been writing all sorts of things saying that she gets him back with bad diaper rashes and not cleaned and total lies.

WHat do you mean about intellectual property? All the pictures I post, I have taken myself, I never take pictures from her and post them on my page.

This explains it best. The basics of it being that you have an original thought or design or creation that is unique to you and you have certain rights to it.

Okay thanks. This does answer my question partially... do you know if there are ny loopholes as far as the fact that he is under the age of 18 and not my biological son? I mean I've posted pictures Ive taken on my friends' children with my kids and they don't have a problem with it...

Let her take you to court. The judge will laugh her out of court and then you can file a counter suit for slander.

Excuse me, GV70? If you knew ALL the details you wouldn't be saying that. I have done nothing but love my stepson as if he was my own. How dare you criticize me and call me an evil stepmother. Do you even have children?

And secondly, I wasn't saying loopholes in the term you are referring to, JudyKay. The ONLY reason I ever post pictures of ALL my children on the internet is so that my family who all live overseas in multiple countries will have a chance to see the updates and view how their great grandchildren/great neices and nephews are growing up. I'm sure you can relate to wanting to see how family members are doing and what they look like. Most of my family overseas haven't seen ME in over 10 years and they certainly haven't met my husband and our children. And it's better than having to email 100 pictures to family members every month. I take a lot of pictures.
