    Evicting on a joint home loan
    I own my home jointly with my now exboyfriend, that I have a son with. He has now not worked for over a year and has a documented alcohol abuse problem. I need to be able to move a family member in to help me pay bills, until my credit score goes back up and I can refinance into my own name alone.

    How do I evict someone that has no means of paying his half of the mortgage and hasn't done so in a timely manner in 2 years. He is officially over 2 months behind in payments right now.

    He agrees that he needs to leave, but says he has no place to go. I need to save my home and can't with him here not helping with any bills.

    How is the Deed held? Both names? Your name? Who holds the mortgage is meaningless. Who holds the Deed will prevail.

    If you were married you could go to Court to dissolve the union and settle this issue. That, of course, is not an option for you.

    You will have to reason with him - if there's any reasoning with him.

    You can always take him to Court for child support, also. I assume he's not supporting the child if he, you and the child are living in the home. That support would be money in your pocket. If he doesn't pay he could be held in contempt and then you'll have some leverage.

    If he is co/owner ( on the deed) of the property, you can not evict him, since he is equal owner also.
