    Child support and possession?
    My ex won custody of my son earlier this year (about 7 months ago) after my son had been living with me for almost 6 months. She moved out of state. About 3 days ago, she asked me to come get him because she is unable to provide a home for him. She does not consider the house he was living in (her cousin's house) fit, and is living with a convicted sex offender (I didn't know this) who is still on paper, so she has no where for him to live. I have a child support hearing in early September. She is considering giving me temporary guardianship or temporary custody. What is going to happen at the child support hearing and how do I explain this to the judge? I don't know what to do.

    You get your attorney ( hope you have one ) to file a motion giving you custody for all of those reasons.

    Well, there is no way I have money for a lawyer. And legal aid denied me. She also is wanting to give me guardianship of her other son (2), which I obviously have no parental rights to. Both are currently staying at my residence. CPS has investigated the kids already because of her last ex (also a sex offender) and for domestic violence, but nothing was ever concluded. If my son is living with me "indefinately" (a.k.a. until she can get stable... so she says), will they still make me pay child support to her?

    Once you have custody, you apply for a change in the support order.

    I'm pretty sure that you can file for custody and support at the same time. If you have a hearing already scheduled, depending on if they have time to add it to the docket for same time, they can probably just add the custody document in for the same court hearing. *personal experience*
