I have a date set before the judge for early release from probation. How do I act and any feedback on what the judge might be looking for? I have the backing of my probation officer to early release.

First, wear clothes suitable to go to a funeral in. Nothing irks the Court more than inappropriately attired people in the courtroom. Go looking like you mean what you are asking. The wearing of extra earrings, nose rings, tattoos showing, sneakers, ripped up t shirts and jeans are a definite no no.

As far as your demeanor goes just answer the Judge's questions and don't be too talky but be extremely respectful. The words "Your Honor" and "Judge" go very far in a situation like this. Be sure to use them in a sincere way.

And what will he be looking for? Whatever you put in your paperwork to get the hearing in the first place is what he'll be looking for.

It will probably be no big thing really. But it never hurts to ask here and see what we think.

The fact you have the backing of your PO is great. Sounds like it will probably be a slam dunk for you if you follow the dress and speech code I outlined above.

An attorney would be a really great thing to take with you.

Proof that you have held a job, did any and all requirements that the court asked. Even personal recommendations of people in the community

Thank you for the response. Everything you suggested seems like good common sense and what I already had in mind... just needed a "sounding board" I guess. I chose not to have a lawyer present because I am confidant that the judge will go along with my probation officers request, as well as my treatment provider who will be there as well. I feel truly blessed with the love and support I am getting. My court date is Sept. 7th @ 1:30pm, and my nerves are already kicking in Arrgg!

An attorney is really not necessary especially if you have the support of your PO and your ongoing treatment provider. I've seen many people sail through the hearing without an attorney. The only time an attorney would be needed would be if the PO was not cooperative like yours.

Good luck. Please don't get antsy or overanxious about this proceeding. You'll do just fine.

Good Luck on your date! My PO did the exact thing for me 2 months ago but I have yet heard anything back. I'm just waiting and paying my "monthly" supervision fee at this moment :(

My po responded to my 2nd motion for early release to the court, even though she could not "recommend" it, but her memo to the court got me at least the hearing date. It took only a couple days to hear from the court clerk and now it's almost here! My original motion was turned down by the court and that took 4 weeks before I heard about that one. Don't get discouraged! Hang in, and as the Irish are fond of saying "Keep the faith!"

Who is to show cause for what?

If it's "DA is to show cause why early termination is not a good idea", sure that's a good idea.

If, on the other hand, it's "Defendant is to show cause why he should't be drawn and quartered", I would consider that a bad thing. :)
