    What is it when a person witness a false signature?
    A person signed witnessing my signature to a spousal release of retirement funds.. I did not sign this form. How do I proceed to let this company know that their plan administrator signed as a witness to a forged signature? Can I sue the company?

    I need more details - you say that this person witnessed your signature, indicating that you did sign.

    Then you say you did not sign.

    Was the witness a notary?

    I wouid recommend getting a lawyer and have them draft that letter and send it. It will carry a lot more weight than anything you could draft yourself as they can quote relative laws.. etc... plus it's the first step towards legal action if needed.

    The plan administrator witnessed A signature. Its possible the person signing made false representations to the plan admin about their identity. So you can't assume the plan admin willfully signed off on a false signature. So you need to tread more carefully.

    If I'm following the situation here. Someone claiming to be you signed a release form releasing retirement plan funds to your spouse? And you want to hold the company responsible. You need to find out the exact circumstances of this signing. Before you start accusing people.

    I don't know why you want to go after the one who WITNESSED the fraudulent signature. I'd think you'd want to go after the one who FORGED your signature in the first place. HE'S the crook. HE'S the one with your money. Call the COPS.
