Do I have to answer on a job application if I have been through a pre trial diversion
6 years ago I entered a pre trial diverision program (and did not have to admit guilt) in MN and then had my records expunged and sealed. I was told by my attourney ofter the acceptance of the expungement and sealing of my records that I could honestly answer that I had never been arrested or convicted of a crime. I am completing a job application that is asking if I have ever been through a pre trial diversion program? Does the expungement and sealing of these records cover the answer for this?

    Hello l:

You were told that if you were asked about a conviction or an arrest, you could say no. But, you were asked about pre-trial diversion, and that's exactly what you had. Therefore, I would tell the truth.
