    Being sued by credit card company
    I was sued by Chase credit because I have defaulted on my credit card Balance of $18,000. I was supposed to respond in 30 days of receipt but did not. Question: What is there next step ( garnish wages, etc.) and how long do I have before they contact my employer to garnish wages. I won`t be paying and it looks like I will be filing Bankruptacy but I would like to know how much time have now before they actually contact my employer to garnish?

    Have you been notified that a Judgment was awarded against you?

    If so, when?

    They will get a judgement in court, so you will want to keep a check and see when that goes though. But as soon as they get the judgement they can have your company served with court papers within days.

    I only received the paperwork that I was being sued and to respond in 30 days. It has now been 40 days and I did not respond. Will I receive something else from them before they go to my employer to garnish wages?

    Yes, you'll be notified of the Judgment.

    Thank you, But how many days or weeks will it take them to get a judgment?

    It will be awarded on the Court date. You may or may not have been notified of the Court date when you were served. Your time to respond will run out, then it will be heard. If you don't appear (respond) the Judgment will be pretty much automatic.

    The actual Judgment is then "usually" signed, ordered and filed and you are sent a copy. It can take days; I've seen it take weeks. In some cases the creditor has to give you 30 days to pay (after the Judgment is awarded) before the creditor can proceed to seize funds or accounts.

    It varies somewhat by State.
