    How long do you have to wait before getting a divorce after your papers are done?
    How long do you have to wait before getting a divorce after your papers are done? I'm currently seeing someone that has not yet finished his papers, but he feels that it is almost done. He says he has to wait 2 years after the papers are done to divorce her... but I find that hard to believe... how long do you really have to wait?

    Depends on where you are. What Country/State.

    I've never heard of two years (often it's one year with a written separation) but it is possible.

    Yes, first, merely "papers being done" means little, has the other party been served, do they agree to the divorce ? Has all of the terms been agreed to ?

    It can take years if you have to fight over terms. If both agree it is much quicker.

    In canada, its probably already been a year that he has been doing his papers, and he says that they are separated but only staying together for the papers.

    I don't know much about Canadian law.

    But I know a questionable excuse when I hear one.

    He lied to you... When you apply for a divorce in Canada, you may request that a judge deal with certain issues right away.

    Since this is a legal question its been moved from the Divorce forum to a more appropriate forum.

    There are a number of factors involved in a divorce. But if you are concerned ask to see the divorce decree.

    If I had a nickel for every time some man told me that he was either getting divorced or getting separated or was separated but living together for the children, for the convenience, to save money... I'd have a whole bunch of nickels.

    One other legal comment - if he's still married and he's "dating" you, you could very well find yourself the third party in this divorce. That's never pretty and it can get very nasty.
