How do I stop paying child support neither child is in school they are 21 and24
Years old I do not have any back pay and they never received the support then
Nor know I need to stop paying since they are grown and he is just banking
The money but not giving any to the girls.

You need to check the detail of the support judgement, but it normally stops when the children either reach majority or leave full time education.

Of course child support is not "given" to the kids when they are smaller and at home, it helps pay for rent, food, electric and more that is being used by the child.

Are the children still living at home ?
Are they in school ( college or trade)
What exactly does the child support payment say about when paymet stops

My oldest moved back with me at age 15 and my other daughter moved back at age 17 the oldest is not in school the other child is going to colledge on a grant not with his support

It doesn't matter WHO lives WHERE, and ALL that other stuff. What matters is the COURT ORDER. It's the ONLY thing that matters. Curlyben asked you to read it and report back. He's right.

After they moved back with you, I will assume you did not go back to court at that point and change custody and stop child support??

That was what was suppose to happen.

Are you saying that you've been PAYING child support on BOTH daughters for 5 years, while they lived with you, and you did NOTHING but pay every month?? Really?? Nahhh. Ain't nobody going to do that.

Since one of the girls stayed with him no I did not we went through a private attorney and it was suppose to stop at age 18 and or continue if they go to colledge

Linda actually many of us are very good at what we do here, and there are even a few lawyers that do come to these boards, but to be honest, if you don't want to give us enough info to work on, what are we do to.

If you write a check and were suppose to stop by order at 18 if not in college, why are you still writing a check ? Sorry but that would be the first thing anyone would do, stop sending a check, and make the other party go to court if you were not suppose to stop.

Linda, Your report about your responses has been received, but I'm perplexed. I don't see anyone who has been rude to you.

But your story does strain credibility. Look at it from our point of view. You know that a court ordered you pay child support because the court is taking the money from your pay. Yet when circumstances changed you apparently did not see if you could go back to the court for a modification. This is, to most of us, a logical thing to do. Then after both children moved in with you, you still made no move to go back to court. And when the children reached majority, you still let the money be taken from your pay. I for one, don't quite understand why you let that happen.

But the bottom line is simple, you go back to the court that issued the support order and point out that the children have lived with you for several years and have passed the age when the support order continued payments to.

You won 't get a refund, and it will probably take some time for the bureaucracy to work, but you should get payments stopped.
