    Tax return processing if ITIN application is rejected
    Hi

    I am H1B visa and my wife is on H4B.

    I applied for my wife's ITIN with tax returns. Her ITIN application was rejected. I have resubmitted application for my wife ITIN with copy of my tax returns. I am waiting for her ITIN card.

    During the time, IRS has processed my tax returns without giving me exemption for my wife. They have sent me a notice to pay 550$ that I owe to IRS. They explained the reason that ITIN number for my wife is not mentioned on the tax return.

    What should I do now?

    If the IRS instructed you to re-submit the ITIN application (Form W-7) with copies of the tax return, they should adjust the return to allow her exemption when they issue the ITIN.

    This may be a case of one branch of the IRS not knowing what another branch is doing. This being the case, you need to call the IRS and ASK for guidance on how to proceed. The notice which the IRS sent you will have a phone number to call.
