    Child living with me for 5 years..
    I have hd the since Oct, 02 2005 until present. The mother gave me the child because her boyfriend didn't want her... I didn't know the mother but my brother whom lives in Cola. S.C. does... he got her on the phone and she agreed to let me come and get here the next week... The chlid was with her grandparents when I arived to pick her up.. They gave me the child, her SS card and birth records... I brought her back to Ga to live with me... I made several trips to Cola. To allow her to visit... after about an hour she was giving back to me... the child neede to be in headstart school.. the mother signed papers to give me guardianship of the child... she has only visited 3 times in five years... now she wants to come take the child back to Cola... what are my chances of keeping this child in a court of law

    Was the "guardianship" papers though court and signed by by the judge ?

    You have little grounds to keep the child, but mother has little grounds to get child.

    You will need an attorney and file in court for at least temp custody

    At this point not giving the child back could make it kidnapping

    The papers I have are by the judge and I just want to know what my chances are in court now that the mother wants her back now after 5 yrs

    First please don't start multiple threads for the same question.

    Since you were given legal guardianship, you stand a good chance of keeping the child. But its certainly not a slam dunk. You should have filed for adoption long ago.
