    Can I sue for unjust enrichment if the principal keeps my paycheck?
    I was a independent contractor working without an "express contract", delivering the Wall Street Journal. I subsequentally found a better opportunity, and I gave my employer a one day notice, and then I left for the other opportunity. The employer decided that he was not going to give me my last pay check, and has, to this day, refused to pay me. I feel that he owes me because he got what he bargained for. Even though we did not have a written contract. I want to sue him on the theory of "unjust enrichment" because I earned that money.

    And your question is?

    You don't need this fancy "unjust enrichment" theory. It's more simple than that. You worked for him and he did not pay you. Simple as that. Take it to small claims &/or the state labor department.

    Right - but have to love the "enrichment theory" lawsuit idea. Next it will be emotional damages due to the stress...
