I got hit from the back at a red light the other driver lied to his insurance company
I was sitting at a red light waiting on the light to turn green a car hit me form the back at the time I do not have insurance the other driver do. The driver told his insurance company two different story that I was at fault the police report says who was at fault(the driver that hit me)now his insurance do not want to pay for my car which is total

I got hit from the back at a red light at the time of the accident I did not have insurance but the driver that hit me did. The driver of the insured car told his insurance company that I was at fault. The police report shows who was at fault which was the driver with the insurance. Now the company do not want to pay for my car it was total what can I do

You'll have to sue the other driver for the damage to your car.
How is it that you are driving a car without insurance?

You've posted the same question 4 times. I've asked that the questions be combined.
You have to sue the other driver AND his/her insurance company.
What are their grounds for denying the claim? Ask for the grounds IN WRITING. It matters little what the other driver told the insurance company - that part I do not understand.
Go to Small Claims Court with your proof (Police Report) and estimates.
- I'm a liability investigator.
Why are you driving uninsured? It has nothing to do with your responsibiity for this accident but it is, indeed, foolish.

I'd tell them to pay up now or they will be paying for cost PLUS your legal fees when you take them to court. And don't settle for anything less than what YOU have coming.
Its worked for me in the past.
Incidentally... depending on what type of coverage you have... your insurance could pay the costs, and THEY will sue them to recover the funds plus costs.

In the case of a rear end collision, the person in the rear is generally considered at fault.
While the police report may be helpful, unless the police officer witnessed the incident or the report included witness statements, its not real proof.
So, tell his carrier that you will be suing if they do not pay your claim against their policy holder.

Concerning legal fees - no Attorneys in Small Claims in most States (not allowed) and filing fees are automatically granted.
