    Violation of misdemeanor probation
    I was entered on probation over a year ago, and was unable to pay my fines - so they reinstated me into probation. I never had a bad urine test until almost the last day of my probation period. I was tested positive for marijuana. I was originally on probation for a misdemeanor possession of drug paraphernalia. This was for a marijuana pipe in my car, but no marijuana was in the car. So I now have a warrant out for my arrest, and will be turning myself in. I am wondering, what do you think will happen - and is there any way to find out what my probation officer recommended to the court/judge?

    Thanks for any help, and this is my only criminal history (other than 3 speeding tickets).

    It's all up to the Judge what happens to you. He may decide to give you some jail time and more probation or just more probation. As far as what the PO recommends to the Judge you can't find out but maybe your attorney can find out.

    I just want to add my editorial comment here... THIS arrest wasn't the result of YOU being a criminal. It's the COPS who are the criminals here...

    Do you think I should get a real attorney or should I get a public defender? I heard they can be just as good, you just have to keep track on them. And, thank you for your insight to my problem.

    YES.. please do yourself a favor and get an attorney. My boyfriend was recently arrested for a warrant for violation of probation. He was put on probation over a half a joint and didn't complete his community service. So far he has been sitting in jail for 10 days, has not heard from a public defender, has not had a visit from his probation officer and has no court date set.

    I would get advice from a lawyer before you turn yourself in.
