I have a 55 yr old uncle who is on disability for being mentally retarded. According to SSI he was capable of living on his own, just not managing his money. However, he was put in jail October of 2009 in Augusta, Ga for possession of .2 grams of cocaine. He admitted to a public pretender (defender) that he was not a user but purchased it for a "girlfriend".I know they work for the state first and the client second, but they had him to plead not guilty and asked him questions like he understood what they were asking him. I am his rep payee and at the time i was living in Atlanta managing his bills. I'm aware that it was due to the type of drug the reason they gave him a felony, however i don't understand why he's on two years of probation for a first time offense. He has no previous record of drug abuse, use or charges. How can I get his name cleared or get the probation dropped, because I went through a series of situations after he was indicted. I got sick, lost my job, home and got approved for unemployment. I had to move in with him in the neighborhood he got in trouble in. So that I can get my life back on track and still do what I'm supposed to do for him. Now I'm trying to get us out of the current environment and away from the woman he claims that is a friend. I try so hard to keep her away from my home but eventually she is going to push me too far and I will catch an assault and battery charge. He could lose his benefits & we'll both be homeless. I found a house in SC that is cheaper than the rent we pay for an apt in GA. Where we stay the unemployment state rate is higher than the national rate and people don't consider getting unemployment an income. I'm tired of looking at the projects nor am I used to them. I'm only 28 in college and stay in the house like a hermit because these people are taking advantage of him when I'm not around. I just need someone to look at it from the outside and give me insight before I do something erratic from anger and out of character.
