    The house I live in was in my brothers name and he passed away and it is in probate
    The house I live in was in my brothers name and he passed away and it is in probate. My brother didn't leave a will and this was my family's home. He was married for about a year and a half before passing, so we are all beneficiaries. Her lawyer just sent me a letter stating I had 30 days to quit and move out because they need to sell the home. Is there anyway for me to stay a little longer? I am on unemployment and trying to find a place to live.

    Have you tried talking to the wife about the situation? Were you paying rent?

    Well actually I don't think "we are all" benificiary, in fact most likely just the wife, assuming they were married at the time of his death, and/or his children if he has children. A brother has little right to inheritance if there are other family members.

    So if you have a lease, it has to be honored.
