    Can the victim talk to your probation agent?
    Hi. I missed two payments on my restitution and the "victim" called my probation officer. (I missed the payments because I had surgery on my foot and was flat on my back - I know now that I should have called the court admin. but I was in a lot of pain and in the haze of prescribed vicodin) I received a letter from the court scheduling a probation violation hearing two days AFTER I made the first payment to catch back up.
    My question is a two-fer:
    1. I'm completely caught up now - what are the chances of getting the charges dropped for violating my probation.
    And.
    2. Is the 'victim' allowed to call the PO and suggest 'punishment' like they did?

    I AM NOT A LEGAL EXPERT!

    My input would be this:

    You missed the chance to contact the authorities,they can't see that you were 'flat on your back',they only know that the outcome was that the victim had to call for a resolution of their case,of which they have already won.

    As for #2, Why not!If you were this victim,wouldn't you want to be able to contact someone in authority(your only true legal way to go about having this done without it becoming a'he said,she said', restraining order type fight if you contacted them directly)and have them dictate how they are going to be compensated for losses due them?

    The courts can be lenient,I have seen many get by with puppy dog eyes and a good word from someone in their corner.I would have to think that your probation officer will either hang you out to dry,or maybe not do anything, what with the monies already no longer in arrears.

    Hello f:

    If you're caught up now, and the PO didn't arrest you for the violation, you'll probably be reinstated.

    Of course, the victim can talk to your PO.
