    How to apply ITIN for spouse who is in india
    Hi,

    This is karthik here. I got my W2 form for 2009 and I have an issue that I'm confused about.

    My wife was with me in US from Jan 1 to June 22 , 2009 and then she left to india.

    Now I have to file tax as MFJ and I also have to apply for her ITIN but she and her passport are all in india.

    Can you please explain me how to apply for ITIN in my case where the spouse is out of USA and how to get the passport copy notarized?

    Get copy of passport notarized in India and then take it to the Ministry of External affairs. A certification will be issued in the form of an "apostille," which will be attached to the copy of the document.
    The apostille must stay attached to the copy of the document when it is sent to the IRS.

    Can any body explain what is the exact process to get a notorization from Ministry of External affiars and Apositle.

    The reason being, I am from A small town and it doesnot make sense travelling to Metro City Delhi to get it done?

    By Google, I found US Embassy does notorization if the document is supposed to be used in USA.

    Does that work... Am just curious.. Does Bombay Embassy does it?

    U.S. embassies and U.S. consulates STOPPED certifying foreign documents (to include passport photocopies in early 2009).

    That is why MukatA instructed you on the apostille process.

    Well, I am not sure.. but I did looked at Mumbai consulate website.. and they do notorize the documents. Also I called in to double check and they informed me they do so between 9am to 11am only M-F Walking. For certain type of documents you may take appointments online.

    Hope that helps.

    For passport they told me they charge $30

    I have heard reports that some embassies and consulates are still certifying passport photocopies. If so, they may be operating under some type of exception to the State Department prohibition.

    If you can get it done, go for it! It is both faster and easier than getting the apostille.

    Yes US embassies certify documents, only if the passport has a valid US visa on it, there is a fees though.
