    Who gets more child support the first child or the second
    My husband cheated on me with a woman he works with. We are now separated and he moved in with her. I just found out that she is pregnant with his child. Mind you we just separated 3 weeks ago. And she is almost 6months pregnant!! He says that they had a DNA test but I am not sure how true that is. We are still married and I plan on filing for divorce soon. But until then I am planning on filing for child support. My question is since I have a 4yr old child with this man and now she is pregnant with his child, who will get the most child support me or her.

    How could anyone have a DNA test done at 6 months pregnant? No such thing. The child must be born first before any such test can be done.

    As for child support - the first child gets the majority of the child support money.

    Be sure to file for divorce and ask for temporary child support until the divorce is granted. This way your child support order is already in place and gets first dibbs at his paycheck.

    Some states appear to be following equal distribution of assets among the children. This may because of the "equal protection clause" of the Constitution.

    I believe there was a case in Tennessee about that which poses very good arguments. I'll research it and quote the case very soon.
