    Late payments with a lease that's up
    My ex-girlfriend lives in an apartment complex here in Amarillo, TX and her lease was up in January. She quit her job in December and I've been helping her pay her rent since then because my two younger daughters live with her. Unfortunately this is a bit of a hassle for me and we've been late every month. Management is now threatening today (the 7th day of the month) to start the eviction process. What are her options on fighting the eviction if we pay the rent and late charges before the month is up. Is it any different than a reguar lease seeing as how she's basically on a month to month lease right now?

    It works the same way as if there was a lease in place. If they sue for eviction based on non-payment and she pays in full before the court date then the eviction gets dismissed. However since she's now a month-to-month tenant they can terminate her lease for any reason with 30 days notice even if her rent it paid in full.

    Hey

    Have you contacted the company to get a verbal confirmation that they do want you out??

    Have they tried to renew the lease since it has exp??

    You could have squaters rights

    Sorry, we do pride ourself on the help we give, there are no squatters rights in this

    If given a 3 day pay or quit, if you pay with all late fees then they can not go to eviction with that.

    They may of course with a 30 day notice merely ask you to leave since the lease has expired
