My sister is about to be 21 years old and she has a daughter about to be 4 in October. We have come to find out that my sister and her boyfriend is on drugs and have been doing it around my niece. There has also been an incident where the boyfriend has rared back to hit my niece. I just want to know if my husband and I would have a chance to get her or at least temporary custody of her. I do not work only my husband does and we have a 9 week old daughter ourselves. Would it be possible for us to do anything?

Not exactly... They need to file in Court for guardianship.

that's why i said, 'may.' I've known a couple people who had to be approved as foster parents before taking in their nieces. sorry if i was wrong

I do not know which state had jurisdiction and why it was required but generally all states have
Relative Caregiver Programs./they are different from foster care programs/
Relatives, are frequently called upon by family circumstances to step in as caregivers for children.There are some possibilities:
1 Guardianship/ in all states/
2 Legal Custody

Maybe they had to attend homestudy programs which are similar to relative caregiver programs.
