    Mother left child, father wants him
    Ok my ex and I had a child, he is currently 8. She took off with him to ausstralia when he was 1, which I agreed that she could go to visit family and come back. She left me while she was there for another guy. I did not fight and left her with him because she was taking care of him somewhat. Recently I found out that she has moved back to the states but left our child there. She was suppose to go back just like when she took off for australia. We have never fought for custody and I am currently the only one with his birth certificate and SSN. I want to fight for custody now and want to know if I have a fighting chance. I am military and now married. I keep in touch with my son even though I haven't seen him face to face since he was 1, on web cam and phone. She is still not married, has no job, and from what I found out is now pregnant again being supported by her father who agrees I should fight for custody. I feel she has abandon my son there for a new guy, which seems to happen to often. Someone help me with some info and opinions, before I go back to the states and talk to lawyers.

    You need to go to court and get an action started against her. Under what conditions did she leave your son behind? Have you ever had any proceedings with the courts like for child support ?

    I have never had any court proceedings. She left our child with her mother. Her mother is single working woman and leaves my son with her other daughter who is handicap when she is at work and he is not in school. I plan on taking this to court when I leave Iraq. Just want to know my chances before I even try or other people opinions on this

    Well I don't know much but you will have a better chance at getting your kid back because she has no job or anyway of supporting him, but do it fast..

    I think you have a good chance. You have been keeping contact and, I assume, providing some level of support. The fact that she left him in the care of someone else, give you a leg up. BUT, you are going to be involved in international law issues here. So you ABSOLUTELY need an attorney. Have you talked to the legal assistance provided by the military?

    I would start legal proceedings immediately. You can stipulate that you will take custody when you return from Iraq, but you shouldn't wait to start any proceedings.

    I haven't started anything because I want to talk to a lawyer. Right now Im in a part of Iraq with limited resources. I have talk to military lawyers but they reply with we can't help you, that I have to talk to a family lawyer outside of the army.

    I would do this very quick like. I'm just trying to say things could turn around and she could support him.I have been though this with my husband and his ex. We had to fight for him and witch we won because she had no way of supporting him.but things can change once she finds out you want to take her to court and she could find away to support him
