Should I file as Married filing jointly or sepeartely. F1 Visa
    Hi,
I am currently on my F1 Visa. My wife is currently with me in US. We are married since 2008 January. My wife is not working. Should I file taxes as Married filling jointly or married filing separately. I filed taxes last year through HNR block, and they filed it as Married filing separately. I believe I should be filing as Married filing jointly. Please advice.

If you did not complete 5 years on F-1, you must file nonresident tax return Form 1040NR or 1040NR-EZ and 8843.
You filed wrong return in 2008. Now you should file amended tax return Form 1040X for 2008 with properly done nonresident tax return.
For 2009 also, file nonresident tax return. Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents
