    Married and part year residents of different states
    Hello,

    We got married in April, 2009. I was a resident of NY through September, 2009 and worked in NJ and resident of VA oct, 2009-dec 2009 while My wife was a resident of VA and worked in VA for the year 2009.

    How do we file the taxes? I guess my question is how do we avoid getting double taxed in NY and VA?

    1. You file NJ as a non-resident -paying taxes on your NJ-based income.
    2. You file NY as a part-year resident for the period Jan - Sep. Because your wife never lived nor worked in NY you can file in NY as Married Filing Separately (even though you are filing as Married Filing Jointly for your federal return). You take a cedit for taxes paid to NJ, so you will probably owe very little to NY (unless you were a resident of NYC or Yonkers).
    3. You file in VA as Married Filing Jointly, report both your incomes for the full year, and take a credit for income taxes paid to NJ and NY. This way you avoid being double taxed.

    I think so. Only part that may not work automatially is the filing status for NY - the program may default to MFJ instead of MFS since that's how you would file your federal return. Try it and see.
