Full year or part year resident in New York?
Full year or part year resident in New York?

I have been permanent resident of USA since 10/4/2005.

I worked in Oklahoma until 01/23/2009. After that I moved to NYC on 1/31/2009 until now (march/2010) I will continue living in NYC.
My wife came to USA with visa H1B on 01/30/2009 we got married in July 2009.

My question is if we are full-year resident or part-year Resident in NY? What would my status be in Oklahoma?

Thank you in advance for your answer.

You are part year resident of Oklahoma. Report income earned until 01/23/2009.
For NY you are full year resident. Report worldwide income for the year including Oklahoma income. Claim credit for taxes paid to Oklahoma. Your U.S. Tax Return: Working or Living in Two or More states

I disagree with Mukata on this one. I suggest you file as part-year residents of NY, not full year residents. Th ereason is that if you file as full-year NY residents then you will pay taxes on your OK income to NY at a rate that is the difference between NY State + NY City resident tax rate over the OK tax rate. But if you file as part-year resident of NY State and City then you do not have to pay NY anything on your OK wages.

I got this link. So I think ebaines is right. http://turbotax.intuit.com/support/kb/state-taxes/multi-state/1945.html#2 . So here says that you are part year resident to both states.
