    Do you have to formally evict a juvenile living in your home?
    My nephew was living in his fathers apartment garage when he and his fathers girlfriend got into an argument. She is the legal owner of the property and she demanded he leave immediately. He was not able to retrieve his belongings and has yet to be allowed back on property. This incident happened in November 2009 and he is now and was then 17 years old. If it matters this occurred in Florida.

    Yes, whenever dealing with a legal issue your general area does matter.

    Did your nephew go to the police? What the girlfriend did constitutes an illegal eviction. It makes matters worse that he was a minor. He should be able to go to the police and show he was living there and be allowed back in to, at least, get his belongings. He problem now is that he has let 5 months go by without taking appropriate action.

    She for one can not legally just throw him out, he could have went to the police ( when it happened) to go with him to get his belongings.

    After 5 months of doing nothing, most likely his belongings have long been throw out as he deserted them.

    But he can go to the police and they may go with him now. If not, he will have to sue for the value of what he was not allowed to get.

    ** as a minor his paretns or guardian may have to sue or go to the police with him.
