    H1b out of status- 180 days bar
    Hi
    I was on H1b last year. My last payroll ran on Oct 9th 2009 and in Nov 09 my employer filed for cancellation of my H1b. Got the cancellation on Dec 7th 09 from USCIS. Now as per rule I cannot exceed out of status for more than 180 days.

    Does this 180 days count from the day my last payroll ran or the day USCIS cancelled my H1b?

    Generally speaking, it runs from date of termination. Please note that the USCIS regs, adjudications and case law are not consistent in interpretation. Good luck.
