    Hi,

    I'm on H1B (resident alien) and my wife is on the H4. She doesn't have an SSN and we have been filing jointly in past years using her ITIN. We are in process of purchasing our first home and the lender will only have my name on the loan. As such I will be the sole purchaser of the home on the sale contract and the deed. My question is: in this case, are we qualified for the $8000 tax credit, filing jointly (my income exceeds the single filer range of $125 - $145)?

    Yes, you are qualified. The ITIN does NOT stop you from claiming the $8,000 First Time Home Buyer's Credit.
