    Will the judge over rule the GAL recommendation
    My soon to be ex is trying to get placement of our three kids. The GAL seems to think that he should have placement, because I have decieded to move on with my life before the divorce is final. This divorce has been going on for more than a year! My ex has OWI convictions, no driver's license, lives off his parents, and makes less than $800/m. He doesn't even really spend time with the kids when he has them. The youngest one asks for Grandma more than the dad! How can I have piece of mind that the judge will do the right thing and over rule what the GAL has recommended?

    More then likely they will rule with the recommendation of the GAL. That is why a report is being made so it gets out of the judges hands and into someone's that can spend more time on it. The only way would be to prove the GAL wrong. So unless you have evidence that should bar any changes then that is what the courts are going to recommend.

    I have eviedence, I gave proof of his OWI's and the paperwork stating that he had the minor child in the vehicle. I just don't understand how the GAL can be so blind and fall for my ex's lies and manipulations.

    Well by your own admission he is going to have supervised visitations. So the GAL most likely doesn't see the danger at this time. You can't deny visitation on suspicions or on guesses.

    I am not as mean and petty as he his. I have no problem with him spending time with them, or having 60/40 placement. I just don't think that it is in their best interests to be living in that environment, with his temper and drinking binges. The GAL seems to think that there would not be any problems and that he would suggest that he(ex) doesn't have any alcohol in his home or drink when he has the children with him during his visitation times. The GAL thinks that because I work outside the home and have a new life tha I am starting that I will not have enough time to spend with the kids. My ex has never spent time(quality time) with them. Rarly attended any school events, sports, conferences etc. But that seems to make no difference now. My 4yr old never asks about his Dad when he is with me when he gets up set he asks for grandma! I am sorry but I feel that there is something wrong with that.

    Has the GAL conducted interviews with the kids? Has the GAL conducted an in depth interview with you where you were not ranting about HIS shortcomings? Sometimes the GAL's don't like to hear constant rantings about the other party in the matter. And yes, the Judge can do an evaluation on their own and side with the GAL. I have very rarely seen a Judge not side with the GAL's recommendations. Sorry.

    Have psychological evaluations been done on you and your ex? Sometimes even though it's expensive it can show just who is the manipulative party.
