    H1B and H4 tax question
    Hi!

    I married my husband in Martch 2009 and moved from Canada to US. Now I have a H4 visa and my husband has H1B visa. He started work in US in 2005. I have questions about how to file our tax.

    1. Should we file our tax as a family? Shoule we use the 1040NR form or the 1040EZ form?

    2. Currently, I am studying in US and I don't have any income in US. Can we file my tuition as a education expense of our family?

    3. I worked in Canada from Jan 2009 to Martch 2009. I am holding Canada PR cards. Someone told me I also need to file my Canadian tax return to US IRS. Is that true? If it is, how can I file them? Which form should I use.

    1. You can file joint return as residents or as married filing separately. You can not file nonresident tax return.
    2. File joint return and claim education deduction or credit.
    3. On you return, you will both report worldwide income for 2009. If you have any foreign income, and on that income you paid taxes in the foreign country, then you can claim foreign tax credit (Form 1116) or you can use Foreign Earned Income Exclusion (Form 2555). Your U.S. Tax Return: U.S. Citizen or Resident with Foreign Income
